LAW 647 - Health Care Fraud and AbuseCredits, 2 sem. hrs.This course examines federal and state laws that impose criminal and civil penalties on health care providers for a variety of fraudulent activities. The course explores the implications of the federal Anti-Kickback statute, civil monetary penalty and exclusion laws, anti-referral (Stark) laws, and false claim laws, as well as traditional federal white collar criminal laws and certain regulations and advisory opinions applied to health care. The course will use statutes, case law and commentary to identify the various forms of fraud and self-dealing and the law’s response. |
