LAW 749 - Conflict of LawsCredits, 3 sem. hrs.A comprehensive study of the conflicts or dissimilarities between the laws of the various jurisdictions (state, federal and foreign), and especially the situations in which the courts must make a choice between competing rules, as well as the old and modern theories which compel these choices. The course also includes a study of relevant aspects of jurisdiction; presumptions as to applicable law; public policy; domicile and residence; divorces and other domestic legal adjustments; crimes, penal and tax laws; torts; contracts; adoption; real property; wills and decedent’s estates; transfers of personality and realty; foreign decrees or judgments; negotiable instruments and stock certificates; and estates by legacy or descent. |
